Can you claim if you’re hit by a drunk driver?<\/strong><\/h3>\n

You can claim as a victim injured in an accident where you are hit by a drunk driver. Although getting behind the wheel driving may invalidate insurance on a technicality, it doesn\u2019t usually mean the insurers can avoid paying out. If they did, you would have to sue the driver responsible for personally, which is incredibly hard to do.<\/p>\n

Do you need to prove the driver was drunk?<\/strong><\/h3>\n

You don\u2019t need to prove that the driver was over the limit if you are hit by a drunk driver. Essentially, the way the liability works is the same as it normally would in most other cases. If the driver is at fault because of whatever it is they did, they should be liable for the claim. It may have happened because they were drunk, but the underlying factor that negligence still occurred is the key thing.<\/p>\n
